“A ruling by the European Court of Justice in October 2005 confirmed that development plans in the United Kingdom were required to be subject to assessment similar to those required for projects under the provisions of Article 6 (3) and (4) of the Habitats Directive 1992. Regulation 48 of the Conservation (Natural Habitats, &c.) Regulations 1994, and as amended for Scotland in 2007, (known as the Habitats Regulations) transposes these requirements into UK law.  As the competent authority, Fife Council has carried out an appropriate assessment of the impact of the policies and proposals of the Kirkcaldy & Mid Fife Local Plan upon the features of interest of designated European nature conservation sites known collectively as Natura 2000 sites).  “
