Strategic Environmental Assessment
The Environmental Assessment of Plans and Programmes (Scotland) Regulations 2004 have made Strategic Environmental Assessment (SEA) of local development plans a statutory requirement. SEA has been undertaken in preparing the Pre-Examination Modifications to comply with the regulations and European legislation. Version 3 of the Environmental Report assesses the likely significant environmental impact of the modifications. The comments received to version 2 of the Environmental Report have been reviewed and taken into account in the preparation of version 3 which has been prepared for consultation alongside the Pre-Examination Modifications.
Appropriate Assessment
A ruling by the European Court of Justice in October 2005 confirmed that development plans in the United Kingdom were required to be subject to assessment similar to those required for projects under the provisions of Article 6 (3) and (4) of the Habitats Directive 1992. Regulation 48 of the Conservation (Natural Habitats, &c.) Regulations 1994, and as amended for Scotland in 2007, (known as the Habitats Regulations) transposes these requirements into UK law. As the competent authority, Fife Council has carried out an appropriate assessment of the impact of the Pre-Examination Modifications upon the features of interest of designated European nature conservation sites known collectively as Natura 2000 sites. The comments received to version 1 of the Appropriate Assessment have been reviewed and taken into account in the preparation of version 2 which has been prepared for consultation alongside the Pre-Examination Modifications.
